Environmental Claim Management, CGL and EIL Underwriters
Mr.
Adams has provided technical claims management services for several of
the nation’s largest Comprehensive General Liability (CGL) and
Environmental Impairment Liability (EIL) underwriters encompassing a
broad range of review activities regarding environmental investigations
and remedial activities for numerous sites. Contamination issues
ranged from petroleum fuel leaks at service stations to heavy metals and
solvent releases at Superfund Sites.
This work includes a
detailed accounting of costs incurred by the insureds, determination of
appropriateness of the cost, consistency with the insurance policy
guidelines and recommendations for payment achieving significant cost
reductions and project closures. Technical services include project
consultation for project cost management, settlement cost negotiations
and development of site closure strategies.

Environmental Insurance Litigation - Manufacturing Facility
Mr. Adams initiated and managed, on behalf of a major manufacturing concern, a successful 5-year effort to gain coverage under applicable liability policies. Mr. Adams provided corporate, participatory and expert witness testimony regarding the source, causes and investigator and remedial efforts associated with a major Superfund Site. Coverage was sought under policies written by 6 insurance concerns over a 10-year period. Mr. Adams managed the technical and legal effort, participated in settlement discussions and reviewed deposition testimony as part of the managerial role.

CERCLA Private Cost Recovery Action, Nationwide Manufacturing Concern
Mr. Adams coordinated the review and production of documents, work plans, public notice provisions and investigation reports in accordance with the National Contingency Plan (NCP) to assure that work performed at these facilities was consistent with, and potentially recoverable within the framework of CERCLA. Appropriateness of costs incurred and ultimately recovered was defended in depositions and settlement conferences in the course of the recovery action.
